James J. Pepper is of counsel to the Firm in its Blue Bell office. Mr. Pepper focuses his practice on qui tam, or whistleblower, litigation and also practices in the area of class action, employment, health care and insurance fraud.
Mr. Pepper has extensive experience in prosecuting qui tam cases. On September 2, 2009, Pfizer entered into a $2.3 billion settlement with the federal government to settle qui tam actions relating to Zyvox, Bextra, Geodon and Lyrica. Mr. Pepper was the attorney of record for the Zyvox case, which was settled for $98.5 million. He also represented the City of Chicago in its case against Pfizer relating to the illegal marketing of Zyvox and Bextra. His efforts enabled the City to recover money it paid for off-label prescriptions of Zyvox and Bextra. It was the first time any city recovered money in a pharmaceutical qui tam case.Prior to practicing law, Mr. Pepper worked in a wide array of positions in the pharmaceutical industry.
Mr. Pepper is a graduate of the Temple University School of Law. In 2009, he was named a Pennsylvania Superlawyers "Rising Star." While in law school, he taught high school history in the Philadelphia Archdiocesan school system. He also holds a Masters in Governmental Administration from the University of Pennsylvania and a Bachelor of Arts degree in politics with honors from De Sales University. In his junior year of college, Mr. Pepper was selected to be a Rotary Foundation International Scholar and studied at the University of Dublin, Trinity College.
Mr. Pepper is licensed to practice in Illinois, New Jersey, Pennsylvania, the Northern District of Illinois, the Southern District of Illinois and the Eastern District of Pennsylvania.
